Off-road diesel is dyed red, so the two kinds of diesel aren’t mixed up. The red dye also allows for testing to determine which type of diesel is being used. Fines for using off-road diesel in on-road vehicles can get very steep. The IRS alone has penalties of $1,000 or $10 per gallon, whichever is greater, for each incident. On top of that, here in North Carolina there is a penalty of $1,000 or five times the tax on the fuel inside the vehicle tank, whichever is greater.
